Sex scandal: Bail on health ground for accused

SRINAGAR, AUGUST 17: A local court today granted interim bail on health ground to senior IAS officer Iqbal Khandey, an accused in the Kashmir sex scandal. Khandey, arrested by the CBI on June 29, is the first out of the 18 arrested to be granted bail by the court citing ‘‘gravity of the disease’’ afflicting him as the major reason behind the decision.

Khandey’s bail application had been rejected by Chief Judicial Magistrate, Srinagar, on July 18.

‘‘One important aspect of the matter cannot be lost sight of. The accused has admittedly undergone surgery as he was diagnosed to have cancer of the lower lobe of the left lung,’’ the order issued by the Principal Sessions Judge Muhammad Yaqoob Mir said. He also directed Khandey to submit Rs 1 lakh for the bail and another Rs 1 lakh as surety.

The order refers to Khandey’s medical report by a team of specialist doctors from Sher-I-Kashmir Institute of Medical Sciences which says that the accused, being lodged in a crowded room in Central Jail, ‘‘is likely to contract chest infection of both specific and non-specific nature which can prove quite adverse’’.

‘‘In case the accused, because of the serious disease loses his life, then who will be tried and against whom will the order of conviction on proof be passed,’’ the order said.

However, the court has put strict restrictions on Khandey outside the jail. ‘‘The accused shall not leave the limits of Srinagar district without prior permission of this court,’’ the order said and also ordered Khandey ‘‘not to attempt to influence the prosecution witnesses in any manner, directly or indirectly’’.

It also directed Khandey to ‘‘ensure his presence before this court on each and every date of hearing without any excuse except for acceptable just cause’’.

Discounting the CBI counsel’s argument that the accused was likely to ‘‘give a slip to law’’ in case he was granted bail, the court said that Khandey ‘‘is a son of the soil, is deeply rooted, has his family, property, everything’’ in Kashmir.

The court also heard the bail pleas of two former ministers, Ghulam Ahmad Mir and Raman Mattoo, as also the alleged kingpin Sabeena and her husband Hamid Bulla, Mehraj Din Malik and and Shabir Kala, both alleged pimps. The court reserved its judgement on the matter and posted their applications for hearing on Friday. The court also heard arguments of the defence lawyer and the CBI counsel on the chargesheet.

A 23-year old MBA student of Noida is another victim of MMS sex scandal. She was filmed by her boyfriend when she was stripping off his clothes on music. Her boyfriend circulated the MMS because she refused to marry him. This is not the first case of that kind. It is happening in the country from the last few years. In 2004, a boy of class 12 of DPS shot his intimate sex relations with his girl friend and circulated among his friends. Both students were expelled from the school. The girl was sent abroad by her family and the boy got admission in another school after getting bail in the case. The staggering fact of this case was that both were minors. In 2006, a girl student in Aurangabad College returned her home in Shillong, when her MMS oral sex clip became the topic of discussion in college campus.

MMS Sex scandals are not limited to love birds’ adventurous game. There are some cases in the country where Hotel or mall’s employees were involved in putting hidden pinhole cameras in the hotel rooms and changing rooms of the girls. Sometimes, it is found that hidden cameras were put in public toilets also. There are also few news items on internet, if it is to believed, that one gentle man from Pune put the spy camera in the room of the girls, who were living on rent in his building and used to watch them on his TV.

In 2005, three hotel staffers in Ludhiana were caught red handed when they were filming the couple. These incidents are not limited to our country. In 2005, a student of Singapore took the inappropriate pictures of his teacher and circulated them on payment to his colleagues. According to an Asian electronic publication, explicit photographs of a 13-year old Melbourne girl were put on a social networking site, MySpace, by a cyber bully. The girl told that she sent those pictures to his boyfriend.

The fantasy of voyeurism among the youths is one of the important factors in such type of scandals. Modernization has given the easy access to these gadgets. Technology has pros and cons but how you use it, it depends. Internet or modern gadgets can feed you the news from any part of the world or you may use it for chatting with your friends sitting thousands of miles away. It can be used for other anti social purposes also to defame any one or fro other malicious motives. These MMS were not limited in the Delhi only, but could be seen in the mobile phones, computers or Laptops of the youngsters in other parts of the country. This issue was raised in parliament also but nothing happened to tackle these issues effectively.

Many girls are defamed or become the victims of these scandals because their obscene MMS were put on the Internet or circulated among the friends just for the sake of enjoyment, adventure or for quick popularity. Most of the cases are the result of the blind faith of the girl on his partner. And the girls are cheated again and again and again. But I don’t want to put the blame only on boys, girls also must relook their attitude.

I am not the right person to preach the girls or boys, ‘how should they behave in their personal relation’? They have all the rights to decide what they should do and what they should not. But they must not forget the line of decency or the ‘Laxman Rekha’. Crossing the limit may harm the dignity of the relation as a whole and the family’s reputation in the society. No one would come and dictate the norms for them to follow but they have to make their own rules and their own limits.

After DPS MMS case it was sold in the market and even, on an online website Bazee.com. Later, the CEO of the website was arrested for the crime. The same video was also available online video websites like YouTube and Metacafe. The commercialization of these acts should be stopped. These scandals also raised the question that YouTube and similar websites should be banned. The counter point of this by some ‘intellects’ is that one can not ban cars because robbers are using it for robbery. No one can ban mobile phones because terrorist use them. YouTube, mobile phones, and other websites are used for other purposes also. Yes, the rationale is acceptable. So what are the preventive measures for such kind of incidents? Do we have stringent cyber laws to nab these techno-bullies? Indian government must look in to the matter because youngsters are going stray because there is no one to nab them for their nasty acts.

Stringent cyber acts against these techno- voyeurs should be enacted and the awareness campaign should be run through public interest ads on different media options by the government. The another easiest possible options could be that the girls and the couples in public places must be aware and must inform the police if they found any thing suspicious in the hotel room, changing room or for that matter, any where. Girls should not allow the boyfriend or any one to film their intimate relation, which may be leaked (They should do it or not, it is a difference issue of debate altogether). This is the best way to be away from the unwanted fuss. I think the self-proclaimed ‘moral police’ should come here and show their guts to prevent these activities. But I doubt; they will take any initiative.

1. Shameful news media organizations for using a sex based story to hike their readership / viewer ship. Mid-day has gone one step further and even let the public know how to search for the clip. They are doing this to maintain the publicity that their tabloid is getting.

2. Shameful media exploitation by Mid-Day, Hindustan times and Headlines today

3. By the way, why isn't any women's organization taking action against the media for this exploitation?

4. Well pat your self on your back people, atleast God will be there to punish. God will punish those who promote lust and do things for profit with out thinking about others. God bless you all.

5. 1000's of MMS Scandals are available on the internet, but I think this gal is really unfortunate to have come into lime light. Its only Media and low grade journalism which is responsible for this.
